[edit] Rationale of fair use for Acorn Computers
The image AcornBBCMicroImage.jpg is being linked here; though the image is originally copyright, I (TreveXtalk 16:15, 9 October 2005 (UTC)) feel it is covered by fair use because:
- The image is important to the article, depicting the BBC Microcomputer, which is discussed at some length, and conveying the manner in which Acorn's advertising constructed a conception of the BBC Micro for the public.
- There are no known free or public domain alternatives to this image.
- This image does not limit the copyright owners' rights to distribute the original image in any way.
- On Wikipedia, The image is used for non-profit and informational purposes only.
- The image is of a low resolution . It is therefore unlikely to affect the value of the original work in any significant way.
This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Acorn Computers":
- To illustrate the object in question
- Where no free equivalent is available or could be created that would adequately give the same information
- On the English-language Wikipedia ([2]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([3]),
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.
To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.
The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of low-resolution images of promotional material
- to illustrate the work or product being discussed;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law. Other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Copyrights for more information.
To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
