Photo of Nikolai Brashman from the Russian Academy of Sciences web site: http://www.ras.ru/win/db/show_per.asp?P=.id-49664.ln-ru The image is a scan of photograph which is over 140 year old (see Nikolai Brashman's date of death). It is safe to assume that the author died over 100 years ago and the work is not protected by copyright anywhere. As the later is formally unproven, the image is fair use in the context as the RAS web site has a promotional nature, and is a news/press release of the academy.
