Great Northern Railway EMD NW5 road switcher diesel-electric locomotive #187.
This is a General Motors Electro-Motive Division builders' photo used for publicity purposes. Fair use is claimed based on the fact that the image was created as a historical record and for publicity, rather than to be sold for profit. The picture shows little artistic expression; it is merely a three-quarters shot of a locomotive outside EMD's workshops. The manufacturer took thousands of these images, all posed identically. The picture is being used for educational purposes, to illustrate the product shown in the image in an article about that product in an encyclopedia. The photo is also in low resolution, insufficient for print purposes. The commercial value of this picture, if any, is not harmed by this use.
The picture was obtained through North East Rails.
This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:
- the person(s), product, event, or subject in question
- where the image is unrepeatable, i.e. a free image could not be created to replace it
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law.
