[1] Frank L. Smith was appointed by the governor to fulfill McKinley's term in 1926, after McKinley died. Smith had defeated McKinley in the Republican primary election and also went on to win the general election. The United States Senate, however, voted to deny him his seat because of excessive campaign donations. The governor, arguing that this was an intrusion upon State's rights, refused to acknowledge the Senate's vote. Smith never took his seat in the Senate.
