I believe that this picture is fair use as:

It is usefull in emphasising the character in the Harry Potter universe. It is a low quality scan. It's picture is freely available through the web. The posting of the picture will not inhibit or lessen the potential sales of the product. I'm not sure which license this would fall under, as there are liscence parts for video games, but not card games.
