- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law, as such display does not significantly impede the right of the copyright holder to sell the copyrighted material, is not being used to generate profit in this context, and presents ideas that cannot be exhibited otherwise. The use of the image linked here (Sonicrun_2006.PNG) in the Wikipedia article Sonic the Hedgehog (character) is claimed to be under fair use as:
- The image is only used for nonprofit educational purposes, for identification and/or critical commentary on the copyrighted work.
- It is an image representing only the character and not the actual content of the product (game, character) in question.
- The image is of a resolution far inferior to that of the original, and due to the resulting lack of detail it could not be used for media piracy (e.g. to manufacture illegal copies of the product).
- The supplier(s), creator(s), creditor(s), have been linked.
- Given that the image used only constitutes a small part of copyrighted work, and is of inferior quality, it is assumed that the use does not lessen the commercial value of the copyrighted work.
