This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:

From an article in the eXile. I believe this is fair use since it's noncommericial, doesn't infringe on commercial activity, and is highly relevant to the article. In particular the fact that Ames himself chose the photo to use in an article he wrote makes it useful for illucidating his point of view.
