I, Camcallister 22:59, 10 December 2006 (UTC), feel it is covered by the U.S. fair use laws because:

1.It is a low resolution copy of a photo used for an EP cover; 2.It does not limit the copyright owner's rights to sell the EP in any way; 3.Because of it's small size and low quality, it could not be used as artwork on illegal copies of this EP; 4.It is the promotional shot used for the EP cover so it does not contain the writing featured on the EP cover.
