It is asserted that the usage of this image constitutes fair use under American copyright law when used in the context of discussing the NOC and/or the role(s) its individual members played in it, because the image significantly and educationally contributes to the reader's understanding of the NOC and its members. The usage of the image does not detrimentally affect the government's chances of profiting from its usage, because it is of too poor quality; likewise, the sales of Lim's book are highly unlikely to be negatively impacted, since presumably nobody would buy the book just for this photograph. This image is irreplaceable, because most of the people in it are dead.
