The Spanish Branding Law (Ley 17/2001, de 7 de diciembre) states in its 5th article (absolute prohibitions):
The following symbols may not be registered as private brands: [...]
i) Any symbol reproducing or imitating the Spanish Coat of Arms, the Spanish Flag, Spanish distinctions and official emblems, or official symbols of Spanish autonomous communities, municipalities, provinces or any other municipal entities, unless explicitly authorized.
The Spanish Copyright Law (Real Decreto Legislativo 1/1996, de 12 de abril), states on its 13th article (Exclusions):
Legal provisions or regulations and projects thereof, resolutions of jurisdictional bodies, acts, agreements, deliberations and decisions of public entities, as well as official translations of the mentioned documents, are not subject to copyright.
Given that the flags and coats of arms of Spain and its administrative entities (including their designs) are regulated by Spanish Laws (or Decrees), the aforementioned laws establish that these symbols must be regarded as being in the public domain and free of copyright, as are reproductions of this seal or flag.
