- It is used for educational purposes on the English-language Wikipedia;
- It is too small to reproduce for commercial use and, as such, does not directly compete with the copyright holder's exclusive right;
- It is used to identify the subject of the article, a notable Republican representative to the state of New Jersey; and
- It would be difficult to produce a free alternative which would provide historical context, as Mr. Frelinghuysen worked in the mid-twentieth century.
