Following is a copy of Image:Keith Baker.jpg. I might need it for reference if the original gets speedily deleted and I then get relicensing permission from Baker. — Alan De Smet | Talk 04:09, 28 March 2007 (UTC)

[edit] Not yet in use
This image is not yet in use. My initial research into Wikipedia's guidelines lead me to believe that this may be fair use as a publicity photograph. Unfortunately having actually uploaded the image and gotten linked to guidelines I was previously unfamiliar with, I am no longer certain that this is the case. In the interest of eliminating any possibility of uncertainty, I have asked Baker if he is willing to license the photograph under one of the Wikipedia acceptable licenses (GFDL or CC-BY-SA-2.5) and am awaiting a response. — Alan De Smet | Talk 04:05, 28 March 2007 (UTC)
[edit] Summary
Photograph of Keith Baker, taken by his wife. Provided to me by Baker himself upon my request. Baker specifically granted Wikipedia the ability to use the image, however it's also fair use as a publicity photo for identification (See also Wikipedia:Publicity photos).
[edit] Permission
This is a copy of all email messages I exachanged with Keith Baker in requesting this image. I've deleted my own and Baker's email so neither of use get extra spam. (You can contact me through User talk:Alan De Smet. You can contact Baker using the "Email Keith" link at the left site of his web site.) I've also deleted links to my own web site in my signature, since it's massively off topic and might look like link spamming.

Mr. Baker, I'm working on the Wikipedia article about you (http://en.wikipedia.org/wiki/Keith_Baker). Whenever possible it's nice to have a photograph for biographical articles. Would you be willing to provide me with a publicity photograph, relevant source information (especially who owns the copyright), and explicit permission to use the photograph on Wikipedia for publicity purposes? That's all we would need; if the photograph is specifically indicated as being for publicity use, Wikipedia will be free to make fair use of it to illustrate your article. If you're feeling more generous, it would be great if you could offer license your image under one of the licenses Wikipedia prefers (GNU FDL, Creative Commons Attribution with optional ShareAlike, public domain grant, or Free Art License). Thank you for your time, -- Alan De Smet ''(irrelevant website deleted)''

[-- Attachment #1 --] [-- Type: multipart/alternative, Encoding: 7bit, Size: 2.5K --] Hey Alan! Sorry about the delay. I've attached an image. This is a picture taken by my wife, and we both give our permission for it to be used for publicity purposes on Wikipedia. If the picture is unsuitable, let me know and I'll try to track down something more formal (such as the image on my website resume, which is from my On the Edge card). This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:
- the person(s), product, event, or subject in question
- where the image is unrepeatable, i.e. a free image could not be created to replace it
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law.
Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use and Wikipedia:Publicity photos.
Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license.
Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights.
To the uploader: This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media. Please add a detailed fair use rationale as described on Wikipedia:Image description page, as well as the source of the image and copyright information. Additionally, if the copyright holder has granted permission, please provide further details as to the terms.
If you agree with the deletion, there is no need to do anything.
If you consider that this image may be retained on Wikipedia under one of the permitted conditions then:
- state clearly the source of the image. If it has been copied from elsewhere on the web you should provide links to: the image itself, the page which uses it and the page which contains the licence conditions.
- add the relevant copyright tag.
- then, and only then, you may remove this speedy deletion tag.
Do not remove this notice until this description gives the source and has a valid licence tag.
