1. Image is used solely for the identification of the subject.
2. The image is used on several websites, including the site from which it was sourced, and its further use by Wikipedia is not believed to disadvantage the copyright holder.
3. The subject of the photograph is living, however a modern image of this person would not convey the same information. An image of this person at the time of her notability is more representative, and this image can not be suitably replaced with an equivalent modern image. It should also be noted that since her retirement in the 1940s as a young woman, Durbin has withdrawn from public life to the point of refusing interviews and does not participate in any Hollywood events. This further restricts the possibility of obtaining a more free image of her.
