Fair use is justified in this case, as this image is made public and released to the media, for promotion of the show. The image here is a shot from the show, and would qualify under the same rules for screen shots of television programs. The making of the show, and appearance of the subject of the photo, in the show, was considered a newsworthy event (evidenced by it appearing in the newspaper), which adds to fair use claim for the photograph. The image, as such by itself, is not being sold, and its usage does not therefore deprive the copyright holder of any rights. This is not a high resolution photo, and is not suitable for commercial print re-production. Fair use applies in an article about the show and this particular person's paricipation in it. As the show was shot on a remote location, there is no possible free license image available that would likewise demonstrate what was done in the making of the program, and what was shown on the program.
