It is believed that this image is filed under being fair use for the following reasons:
- Atari has not released any screenshots into the public domain;
- It serves to illustrate the game in question;
- It serves to identify the title screen;
- The image does not limit the copyright owners' rights to distribute the video game in any way;
- The image is being used for informational purposes only;
- Its use is not believed to detract from the original game in any way;
- Its use does not infringe on Atari's ability to sell the game, which is old and hasn't been sold by Atari in decades.
- Atari doesn't want it and has dumped in into a landfill. That's sorta like giving up copyright.
