[edit] FAIR USE RATIONALE
I have tagged this photo as "fair use." Below is my rationale for this move:
- The photograph depicts the non-reproducible historic event of the capture of Abimael Guzmán.
- Guzmán qualifies as a "famous person" because at the time of his capture he was the most-wanted man in Peru, if not all of Latin America.
- It would certainly seem that no free alternative exists or can be created, as a limited number of photographers were allowed to witness the event.
- The image is of such low resolution that "copies made from it will be of very inferior quality."
- The image is no larger and of no higher quality than is necessary for use in the article.
- The use of the image on Wikipedia is not expected to decrease the value of the copyright.
- The image "is only being used for informational purposes" to depict Guzmán's capture.
- The inclusion of the image in an article pertaining to Guzman or his organization, the Shining Path adds significantly to the article because it shows the subject of the article.
- How the event was depicted is very historically significant to the general public because it signified the beginning of the end of a war that claimed nearly 70,000 lives.
- The image is so extraordinarily famous as to rise to the level of being iconic.

- Not only is it Guzman but it is the most famous picture taken of Guzman right after he was caught and put in a cage. Anyway, there really is no point in responding to this at all since it was made in 2004 but just had to make that clear to anyone else who sees this talk page.--Jersey Devil 20:31, 26 September 2006 (UTC)

It is the uploader's responsibility to provide a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information. The uploader has not done this. Frankly, I'm suspecious that the correct licence was used; it is certainly not being used as to provide critical commentary on whatever film it was taken from. In fact, it seems improbable that this was even taken from a film. --Descendall 02:39, 6 October 2006 (UTC)
