Rationale for fair use
This 30 second clip of two tracks (Micky Finn & Aphrodite's Bad Ass (Urban Takeover) 1996 and Sound of the Future's Lighter (Formation Records) 1995 illustrates the use of samples in drum and bass as well as mixing techniques. The samples are the piano theme from the film "South Central" and the film Love Story. They are mixed together by Dj Hype on a compilation CD - Jungle Massive (Warner Strategic Marketing UK) 2001. This sample is used for the purposes of criticism and comment on the article on drum & bass. It is intended, in the context of scholarship, to inform the reader of the sound of drum and bass music and its usage of samples while not displacing the original product.
According to section 107 of the United States Copyright Act of 1976:
The fair use of a copyrighted work...for purposes such as criticism, comment,...scholarship...is not an infringement of copyright. [1]
The clip is used for non-profit purposes and represents only a fraction of the actual work. These two factors are noted as relevant by the Act.
