The Malaysian Road Transport Department (Malay: Jabatan Pengangkutan Jalan Malaysia) (JPJ) is a government department under the Malaysian Ministry of Transport. This department is responsible for issuing Malaysian number plates.

KEJARA System is a short form of the word KESELAMATAN JALANRAYA (ROAD SAFETY) System. This system is especially directed to drivers with CDL driving license and Provisional Driving License.

Specific Meaning : A demerit point system for drivers which have been affirmed for misconducts through compound payment (Police or RTD) or fined (Court) for scheduled misconducts.

  1. To reduce road accidents rate.
  2. To increase drivers awareness on road safety.
  3. To ensure that all drivers obey the road regulations.
  4. To create drivers who are well-disciplined, responsible and tolerant while on the road.
  5. To take action against drivers who have misconducts on the road.

[edit] How does KEJARA system functions

KEJARA System functions under APJ 35, 35A, 37 and 38; and 1987 Motor Vehicle Procedures (Demerit Point).

KEJARA System offender's records are created through summon notices that are related to scheduled misconducts and demerit point will be accounted for.

For drivers with CDL license that have collected 15 or more demerit points, the actions below will be taken :

Points of Misconducts Sentences
15 or more demerit point for the first time Driving license will be suspended for 6 months
15 or more demerit point for the second time Driving license will be suspended for 12 months
15 or more demerit point for the third time (within 5 years) Driving license will be suspended for 12 months and cancellation of driving license will be carried out.

For suspended CDL license, the driver is not allowed to drive or obtain any licenses, either provisional driving license or others, to drive a vehicle from any classes within the suspended period.

For drivers who owned a Provisional Driving License and had collected 10 or more demerit points, the Provisional Driving License will be cancelled.

For drivers whose driving license had been cancelled ('P' License or CDL), are not allowed to drive or obtain any licenses, either provisional driving license or others from any classes for a period of twelve months from the suspension date.

[edit] Recouvery course

Chief Director could order driving license's holders which the license have been suspended, to attend a recovery course. If the license holder attends the course successfully, he/she entitled for a shorter suspension period as follows :

Suspension period Reduced period
Suspension for the first time 4 weeks
Suspension for the second time 8 weeks

[edit] Giving of Bonus

For drivers with CDL license that obtained demerit points less than 15 points, if no scheduled misconducts for next 24 months continuously, 7 demerit points will be deducted.

Driving during the suspension or cancellation of driving license, will be fined RM2,000.00 or six (6) months prison.

1 Driving or controlling motor vehicle under the influence of intoxicating drink or drugs. 15
2 Driving hastily or dangerously. 15
3 Driving without cautious or tolerance. 15
4 Competition or speeding assumption. 15
5 Without any solid reasons, failed to give specimen on breath, blood or urine when instructed by the police officer. 15
6 Failed to obey the traffic lights. 10
7 Exceed the speed limit of any roads or vehicles :
(i) Exceeds 40 km/h 10
(ii) Exceeds 26 km/h - 40 km/h 8
(iii) Exceeds 1 km/h - 25 km/h 6
8 Misconducts that are related to overtaking and blocking during overtaking (including 'Q' overtaking) 8
9 Failed to give ways to ambulans or Fire Brigade; or police vehicles, or custom vehicles, or RTD vehicles. 8
10 Misconducts by drivers at the pedestrian walk-ways. 8
11 Misconducts related to driving on the left side of the road. 8
12 Failed to stop at the junction. 8
13 Reckless in controlling the vehicle (including the use of handphone) 8
14 Using motor vehicle at road blocks. 5
15 Ignore the road instructions and signals. 5
16 Using a bald tyre. 5
17 Overtaking at the doubled lines (continuous lines) 5
18 Failed to obey the conditions stated in the Provisional Driving License (Procedure 15A Motor Vehicle Procedures (Driving License) 1992):
A. Failed to bring along the provisional driving license while driving 5
B. Failed to display identification sign at a visible place based on the diagram in Procedures Scheduled 6. 10
C. Failed to ensure that the alcohol contained in breath, blood or urine are at 0.00 level. 5

[edit] 1997 Motor Vehicle Proedures (Demerit Points)

WHEN carrying out the authority given by subsection 35(2) and 35A(2) 1987 Road Transportation Act, Minister created the procedures as follows :

  1. These Procedures are named 1997 Motor Vehicle Procedures (Demerit Points) and enforced on 1 March 1997.
  1. In these Procedures, besides if the context has a different meaning:-

"schedule misconducts" means any misconducts listed in the Schedule. "driving license" brought meanings given to it by the Act: "provisional driving license" brought meanings given to it under the Act .

  1. The Director, Chief Police Officer, Mayor, Chief Director Malaysia Highway Board or Local Authorities will have to; in cases where the driving license holder has been prosecuted for any scheduled misconducts or has paid the penalty stated under the Section 120 Act for the misconducts; inform the Chief Director and present any relevant points related to the case to the Chief Director.

i.Demerit points stated in the Schedule will be given to the driving license holder that has been prosecuted for any scheduled misconduct or has paid the penalty stated under the Section 120 Act for the misconducts. ii. Demerit points given under subprocedure (1) will be enforced from the date of the scheduled misconducts have been committed. iii. Chief Director will keep records stating the name and particulars of each person that has been given demerit points. iv. In any circumstances of Subprocedure (3), related to the holders of provisional driving licenses; Chief Director will keep the records with names and particulars of each person for a period of twenty four months from the date when the provisional driving license was given.

  1. Chief Director will suspend for period not exceeding 6 months, driving license of any drivers who have been given fifteen demerit points or more.

ii. If a driver's driving license has been suspended under subprocedure (1), and when the driver is given a total of fifteen demerit points or more, the Chief Director will suspend the driving license for a peroid of not more than twelve months. iii. In any circumstances of Subprocedure (1) and (2), if the driving license holder that has been given demerit points did not commit any scheduled misconducts within twenty four months continuously; not including any period when the driving license was suspended under these Procedures or any period when he/she lost entitlement under Court's orders when or after these Procedures were enforced from obtaining a driving license; the Chief Director could deduct not more than seven demerit points in the total of demerit points that could caused the driving license to be suspended. iv. Subprocedure (3) is not applicable when the demerit points given to a driving license's holder after the twenty four months period as stated in the subprocedure for any scheduled misconducts that were committed before the period, and the demerit points will; if given into account with the other demerit points given before the period; make the driving license to be suspended under these Procedures. v.Chief Director could order the driving license's holder, whose driving license has been suspended under these Procedures, to attend a recovery course. vi.If the driving license's holder successfully attended the recovery course, he/she is entitled for a lesser suspension period of 4 weeks for subprocedure (1) and not more than 8 weeks for subprocedure (2). v.For this procedure, "driving license" does not include provisional driving license.

6. i.For the subsection 35(4A) Act, the five year period mentioned in the subsection will be calculated from the date of the driving license first suspension notice produced under subprocedure 8(1). ii.Based on subsection 35A(3) Act, the Chief Director has the authority to suspend a provisional driving license after being given a total of 10 demerit points or more.

7. i.The Chief Director, through a written notice, will inform the driving license's holder about his/her driving license suspension or cancellation under these Procedures and also the date that the Chief Director intend to suspend or cancel the driving license. The driving license's holder will have to give reasons, within fourteen days from the date of the notice, why his/her license should not be suspended or cancelled. ii.From the date stated in the notice, the Chief Director will have to consider on reducing the sentences based on the facts given (if any) that might be presented by the driving license's holder; to make the necessary decision.

8. i.The Chief Director needs to, when asked to make an order to suspend or cancel a driving license; inform the driver in writing about his/her suspension or cancellation and instruct the driver to return back the driving license immediately to the Chief Director. ii.Suspension will be enforced on the date when the driving license is returned back. iii.Any driver with suspended driving license under these Procedures, is prohibited to driver or get any licenses, either a provisional driving license or others; to driver a vehicle from any classes during the suspension period. iv.Any driver with suspended driving license under these Procedures, is prohibited to driver or get any licenses, either a provisional driving license or others from any classes for a period of twelve months from the date of returned driving license.

9.Any notices sent by the Chief Director under these Procedures, could be sent to the driving license's holder through registered post based on the address stated in the driving license and the notice will be considered as being sent in normal post delivery; and will be treated as a sufficient proof that the notice has been delivered.

10.Any drivers who do not obey the Chief Director's instructions under these Procedures, he/she is considered as committing an offence and if prosecuted, could be fined not more than a thousand ringgit or imprisonment for a period of not more than six months; or both.

11. i. 1995 Motor Vehicle Procedures (Demerit Points) is cancelled. ii. Any demerit points which is deducted under these Procedures will be accounted for in the calculation of demerit points under these Procedures. iii. Any sent suspension notices and any driving license suspension made under cancelled Procedures will be accounted for in the next preceding suspension or for cancellation, following whichever is applicable, under these Procedures. iv. When the period of the driving license suspension made under these Procedures ends, the driving license must operate under these Procedures. v. Any records made under cancelled Procedures must be kep under these Procedures
