I believe the photograph to be legitimate for fair use because the website it was obtained from is that of a public television station.
Additionally, the subject of the photograph is the host of a television program produced by that station, and as an example of their copyright policy, they make transcripts of their show available for free download on the internet -- see http://www.azpbs.org/horizon/archives.htm.
