It is believed the use of this image in the article, The Last Waltz, is fair use because:
- The image is a screenshot from the DVD release of the film The Last Waltz originally created by MGM/United Artists, and intended for wide distribution.
- The screenshot is of much lower resolution than the original film (copies made from it will be of inferior quality).
- There are no free or public domain images of this film. The image is not replaceable.
- Furthermore, the subject in the photo is dead, and there is no way to obtain a free image of him, and for that reason as well, this image is not replaceable.
- The screenshot does not limit the copyright owners' rights to distribute the film in any way.
- The screenshot is being used for informational purposes only, and its use is not believed to detract from the original film in any way.
