3. depicts a celebrity/actress "in character" in a currently popular CBS television series, "Jericho," and

4. is apparently the only "solo" picture of said actress and character to be made available by CBS, and

5. is of web-quality resolution, and

6. does not impede in any way the copyright owner's ability to derive profit from the work in question.
