Jane Frank (Jane Schenthal Frank): "April Screen", acrylic sculpture, late 1960s (detail).
Rationale for "fair use in" tag:
This image is from a low-resolution photo, reduced in size and somewhat cropped, of a plate image (itself only a detail, not showing the whole sculpture, and not carrying a photo credit) in Thomas Yoseloff's (now long out of print) 1975 exhibition catalogue entitled "Jane Frank: a Retrospective Exhibition" (pub. 1975, A. S. Barnes) for Jane Frank's 1975 solo retrospective exhibition at Towson College. This image is clearly necessary for the article's discussion of Jane Frank's life and work. The fact that the photo is reduced in size and quality and furthermore not available anywhere else on the internet plainly makes its inclusion in this article an example of "fair use". The use of this photo here cannot possibly adversely affect the commercial prospects for future sale of this book, of the sculpture pictured, or of the art of Jane Frank in general — in fact, the likely effect (if any) should be quite the opposite.
Furthermore, there was no image of this work to be found anywhere on the internet, so it was not possible merely to provide readers with a link to it.
This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Jane Frank":
- To illustrate the object in question
- Where no free equivalent is available or could be created that would adequately give the same information
- On the English-language Wikipedia ([1]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([2]),
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.
To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.
This image is of a drawing, painting, print, or other two-dimensional work of art, and the copyright for it is most likely owned by either the artist who produced the image, the person who commissioned the work, or the heirs thereof. It is believed that the use of low-resolution images of works of art
- for critical commentary on
- the work in question,
- the artistic genre or technique of the work of art or
- the school to which the artist belongs
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use for more information.
To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
