This is an image of 9000 year old flutes found at the Jiahu archaeological site in China. This image was released by the Brookhaven National Laboratory for press promotional purposes. The original copyright on the flute design expired many thousands of years ago and is in the public domain. US federal law, 17 U.S.C. § 1302 prohibits any copyright in useful articles that have not been registered for copyright. Furthermore, 17 U.S.C. § 113 states that in the case of useful articles that have entered actual production for distribution to the public (as evidenced by the fact someone actually made these flutes) that "copyright does not include any right to prevent the making, distribution, or display of pictures or photographs of such articles in connection with advertisements or commentaries related to the distribution or display of such articles, or in connection with news reports." It is contended that the use of this image on Wikipedia involves commentary on and display of these articles, and reports the news of their archaeological find.
