Though this image is copyrighted, I believe its use on Wikipedia qualifies as fair use under U.S. copyright law because:
- It is a single screenshot of a program, and thus does not perform the functions of the program itself.
- Use on Wikipedia does not limit the ability to market Mac OS X.
- Screenshots of copyrighted software are commonly included in both commercial and non-commercial 3rd-party works.
