Not really. Created pre-1923 does not equal published pre-1923. Family pictures are unpublished works. If you have permission from J. N. Parmalee (who, as a cousin, likely would also be the copyright holder or at least know who is if it ain't him, or who might know who took that photo and when that photographer died), then ok, otherwise copyright status unknown.
