fair use rationale text: This image, RIN_Mutineers_Memorial.jpg, is being linked here; though the picture is subject to copyright I (ranam) feel it is covered by the U.S. fair use laws because it depicts visually, and for want of freely available images, the scale, magnitude, and effects and the recognition of the Mutiny of the Royal Indian Navy at harbour in Bombay in 1946.

The assertion that the use of this image qualifies as fair use has been disputed by Bkell. The reason for this dispute is that this image came from a newspaper, so it falls under the fifth fair-use counterexample; also, a free image could easily be created (this is a memorial that can be photographed), so it violates the first point of the Wikipedia fair-use policy. Please provide a rationale as to why this image qualifies as fair use. If no acceptable rationale can be provided, this image may be nominated for deletion in the future.
