- How did you read that as "appears in public"? The studios and factories are not a public area, and the article does not specify in what capacity the subject visits the retail stores. Of course, a photographer may stake out these locations and get an image of him, but they would have a hard time getting a nice picture like this in a retail store or on the street. Also, as the fair use template explained, the subject is posed in an environment where the public has no access to. I will accept that you do not find that the picture falls under the fair use guidelines, so, I even went as far as contacting the copyright holder to get the image released under CC. Which I think I marked when I uploaded the picture again. I understand that you are more of the "strict" followers of the fair-use guidelines, but since the photo was re-realeased under CC, you do not have to worry about it.
