This is presumably still under copyright, perhaps by the RCA record label for which this is a publicity shot. We claim Fair Use here because:
- It is used for an educational non-commercial purpose.
- It is representative of the work "The Big Apple" (which was mentioned in the Tommy Dorsey article way before this picture was uploaded).
- It is a low resolution photo.
- It should not affect the commercial viability of the copyright.
