The photograph captures a seminal moment in the history of independent India. The use of the photo:
- In the Independence of India page, to depict the instant at which that movement achieved its fruition, is certainly fair-use of the image;
- In the Jawaharlal Nehru page, to depict a supremely important and poignant moment in his life, is another fair-use of the image.
