I believe this photo to be fair use on America's Next Top Model, Cycle 8 because:

it shows all of the contestants who are on this cycle in one spot,
there will never be a time where all contestants will be in the same place again, in this state,
this is a promotional shot released by the CW to promote the show, which is how it's being used here, and
this photo has a low resolution.
