The result of the debate was to Delete the image. Shyam ^(T/C) 12:15, 12 December 2006 (UTC) This image simply cannot be replaced. Well, if somebody is dead, it's a lot harder to get a free picture of him. But living former governors should also be tagged in this fashion. —Chowbok ☠ 00:38, 3 December 2006 (UTC)

Well, your refusal to remove the tag at this point is a pointless bother. Your proposal is simply without merit without a free-licenced file uploaded or ready to upload. I agree with you that eventually, an attempt should be made to get a free picture, or to get the state to release under the GFDL, but you provide no immediate alternatives, and the fair use rationale is firm. This image has no basis for deletion on the grounds you have nominated it for. --AlexWCovington (talk) 08:26, 3 December 2006 (UTC)

Our fair use policy forbids using a non-free image if a free image could be created that could be used in its place. See criterion #1 and counter-example #8. In this case, it would be possible to create a free image; therefore this non-free image may not be used.
