[edit] Fair Use Rationale
Although this image, Naulakha_fall.jpg, may be subject to copyright, I (Sanjay Tiwari 19:16, 28 September 2006 (UTC)) feel it is covered by the U.S. fair use laws because:
- it will be used in only two Wikipedia articles, both relevant to the image. These are:
- Rudyard Kipling (Kipling built the house and lived in it from 1892-1897) and wrote the Jungle Books, Kim, and Captains Courageous, while there.
- Naulakha (house) about the house itself, which is a historic house and has been on the National Register of Historic Places (USA) since 1993.
- images of the house are not available in the public domain
- it does not limit the copyright owner's rights to sell the image in any way;
This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Rudyard Kipling":
- To illustrate the object in question
- Where no free equivalent is available or could be created that would adequately give the same information
- On the English-language Wikipedia ([2]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([3]),
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.
To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.
