Linked to from the schoolyard heroes website under the "Press" section. Thus does it fall under the Publicity Photos ( http://en.wikipedia.org/wiki/Wikipedia:Publicity_photos ) rules. I can't find a licensing agreement that fits...sorry for my noobishness.
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.
The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of low-resolution images of promotional material
- to illustrate the work or product being discussed;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law. Other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Copyrights for more information.

This copyrighted promotional photo of the band Schoolyard heroes qualifies as Fair Use for the following reasons:
- No free equivalent is available or could be created that would adequately give the same information. The reasons are two-fold: the majority of user-contributed images are going to be from 1) dark concerts with bad lighting, where the band is spread across the stage and difficult to see, or 2) individual members posing with a fan. Highly unlikely that a decent picture of just the band outside of a concert setting could be found.
- "Can this image be replaced by a different one, while still having the same effect?" No, any free use image would be of very poor quality for the reasons stated above.
- The image, used here on the non-profit Wikipedia to illustrate the members of the band Schoolyard Heroes, is highly unlikely to cause any problems for the band Schoolyard Heroes. In fact, it may even be in line with their goals by giving them free publicity. The image itself still remains copyrighted and cannot legally be used by anybody else without Schoolyard Heroes permission, so I don't see this being a problem.
- The image is already available on Schoolyard Heroes' website, http://www.schoolyardheroes.com/. If high resolution is an issue we can reduce the resolution, but common sense dictates that if we reduced the quality pirates would just go there to get it. Also, we are only using one fair use image to illustrate the band; all other fair use images on the page are unrelated to this, so use of this image is not excessive.
- The material is already published, at http://www.schoolyardheroes.com/downloads/SchoolyardBW.jpg.
- The material is relevant to the article Schoolyard Heroes, and thus encyclopedic.
- The material will be used in the article Schoolyard Heroes, so it will not be orphaned.
- The material significantly improves the article Schoolyard Heroes by offering a picture of the band, which would otherwise not be includable at decent quality.
- Users are reminded that this image should only be used in the article namespace, and must meet WP:FUC when doing so.
