This list of Guantánamo Bay detainees is compiled from various sources. It lists the known identities of detainees at the Guantanamo Bay detainment camp in Cuba.

[edit] Difficulties in sourcing names of detainees

The Bush administration planned to keep the identities of all the suspects in their war on terror secret to the greatest extent possible. However, some of the detainees' identities have become public. Some identities were publicised when the International Committee of the Red Cross was able to contact the detainee's relatives. Such relatives often then made their family member's name known.

In official documents, the Department of Defense (DoD) continues to make intermittent efforts to redact detainee's names, and has not published an official list of detainees (As of September 2005). On April 19, 2006, the DoD released a list with 558 names in what appears to be a fax or other scanned image.[1] Associated Press published the list in more accessible text form [2]. Not all of these names have been copied to this page yet. Since there is no further commentary from the DoD, it is unclear whether this list is official. It is called official by the Associated Press.

The Washington Post maintains a list of the detainees known or suspected to have been held in Guantánamo Bay.[3]

The United States has long maintained camps at Guantánamo Bay for attempted illegal immigrants captured while trying to get to the United States, usually from Cuba, Haiti, or the Dominican Republic.

Although former Secretary of Defense Donald Rumsfeld has said on several occasions that the suspects detained at Guantánamo Bay are "the worst of the worst," it has been suggested that senior Taliban and al Qaeda members are detained in other, more secret interrogation centres, or in countries that practise torture.

According to the DoD, the original detainees came from forty nations.

[edit] Court mandated release of names

On March 3, 2006 the DoD partially complied with a court order to release the names of the remaining Guantánamo detainees.[4] The court order required the DoD to release the names of all the detainees. Initially, the DoD only released 317 names. On April 19, 2006, the DoD released a list with 558 names.

Although justice Jed Rakoff had already dismissed this argument, Pentagon spokesmen Bryan Whitman justified withholding the names out of a concern for the detainees' privacy.

On April 20, 2006 the DoD released a portable document format file that listed 558 names. [1] The 558 individuals on the list were those whose detention had been reviewed by a Combatant Status Review Tribunal (CSRT). The list gave the detainee's ID number, their name, and their home country.

The names of several hundred detainees who had been released prior to the commencement of the CSRT were not released. The list didn't specify whether the detainees were still in detention at Guantanamo; whether they had been determined to be "enemy combatants"; whether they were released, or repatriated to the custody of their home country.

On May 15, 2006, the United States Department of Defense released what they called a complete list of all 759 former and current inmates who had been held in military custody in the detainment camps after a Freedom of Information Act action was filed by the Associated Press. [5][6]

[edit] Arresting authorities

The Bush administration describes those detained at Guantánamo Bay as illegal combatants against the United States, although many were not captured solely by American forces. In Afghanistan, many were captured by the Afghan Northern Alliance, who worked in conjunction with U.S. and British forces.

During legal proceedings regarding Jose Padilla, the government claimed that the battlefield in the "war on terror" is worldwide.

[edit] U.S. Government denial of abuse

The United States government, through the State Department, makes periodic reports to the United Nations Committee Against Torture. In October 2005, the report focused on pretrial detention of suspects in the War on Terror, including those held in Guantánamo Bay and Afghanistan. This particular Periodic Report is the first official response of the U.S. government to allegations that prisoners are mistreated in Guantánamo Bay. The report denies the allegations.

The report notes that the United States and its coalition partners are engaged in a war against al-Qaida, the Taliban, and their affiliates and supporters and that 'there is no question that under the law of armed conflict, the United States has the authority to detain persons who have engaged in unlawful belligerence until the cessation of hostilities. Like other wars, when they start we do not know when they will end. Still, we may detain combatants until the end of the war." At the same time, the report continues, there is a commitment to humane treatment of prisoners.

Pentagon spokesman and Lieutenant Colonel Brian Maker noted the lack of credible evidence from any investigations, "To suppose that these people are being left bleeding - I know of no instance of that, there's been no reports of that, there's been no credible evidence produced by any investigation of that fact," referring to the bleedings resulting from force-feeding via tubes inserted forcefully through the noses and into the stomachs of the suspects.[7]

Approximately 750 suspects have been held at Guantánamo Bay. Approximately 250 have been released, or transferred to the custody of their native countries. Some of these were then quickly released, since there was no evidence of involvement in any crimes. The Bush administration continues to classify many of these released detainees as "illegal combatants".

The Washington Post maintains a list of detainess who have been mentioned in media reports and press releases. Approximately 750 suspected unlawful combatants have been detained in Guantánamo Bay. The Washington Post lists about 420.

On March 5, 2005, The Daily Times of Pakistan listed seventeen Pakistanis who had been released from American custody. "forty Pakistanis still at Guantánamo, some may be freed"

  • Cageprisoners.com is a site that compiles information about detainess in the war on terror. It is said to be maintained by British volunteers. One of its pages, "The kids of Guantánamo", lists a dozen Guantánamo detainees who were children when they were captured.

The Associated Press made Freedom of Information Act requests for the documents compiled for the CSRTs of Guantánamo detainees. The unclassified portions of the records of dozens of CSRTs were released to AP.[9] They made those documents available to the public for download in pdf. Their library of dossiers includes detainees not listed in the Washington Post list. There are also detainees listed there who may be in the Washington Post list, but with their names spelled differently, or listed with additional middle names.

On March 3, 2006 the DoD partially complied with a court order to release the names of the remaining Guantánamo detainees.[3] The court order required the DoD to release the names of all the detainees.
